Seller Legal Notice

Buy More Mall Kenya is an online marketplace that hosts listings from independent Sellers. This notice summarises key legal obligations that apply to Sellers in Kenya, and explains our role and how we deal with unlawful listings. It is general information, not legal advice. Sellers should take their own professional advice about their business.

Our role

We provide the platform on which Sellers publish listings and buyers place orders. Each Seller is the seller of record for their own products and services, and is responsible for complying with the law. We do not check every listing before it is published, but we act on reports and remove unlawful content.

Consumer protection

Under the Consumer Protection Act, 2012, Sellers must describe goods and services honestly, must not make false or misleading claims, must display prices clearly, and must supply goods of reasonable quality that are fit for purpose and match their description. Unfair practices, such as bait pricing, hidden charges or false "sale" claims, are not permitted.

Product standards and safety

  • Goods covered by mandatory standards must meet them and carry the required marks under the Standards Act and Kenya Bureau of Standards (KEBS) rules.
  • Quantities and measures must be accurate under the Weights and Measures Act, for example litres, kilograms and metres.
  • Regulated products need the relevant approvals, for example from the Pharmacy and Poisons Board, the Kenya Dairy Board, the Pest Control Products Board, or the Energy and Petroleum Regulatory Authority.
  • Sellers must stop selling, and tell us about, any product that is recalled or found to be unsafe.

Counterfeits and intellectual property

Selling counterfeit goods is an offence under the Anti-Counterfeit Act, 2008. Sellers must not list goods that infringe trademarks, copyright, patents or designs, and must not use other people's photos or brand names without permission.

Tax and business registration

  • Sellers must have a KRA PIN, and file and pay their taxes.
  • VAT-registered Sellers must include VAT in prices and issue tax invoices through eTIMS as required by the Kenya Revenue Authority.
  • Businesses must hold a valid county business permit and any sector licences.

Data protection

Sellers who receive buyers' personal data must handle it lawfully, securely and only for the order, under the Data Protection Act, 2019. Businesses that meet the registration thresholds must register with the Office of the Data Protection Commissioner.

Online conduct

Fraud, phishing, and unauthorised access to accounts or systems are offences under the Computer Misuse and Cybercrimes Act, 2018. We report such activity to the authorities.

Reporting unlawful listings (notice and takedown)

If you believe a listing is counterfeit, infringes your rights, is unsafe or is otherwise unlawful, email info@buymoremall.co.ke with the subject "Listing report". Please include:

  • the link to the listing
  • your name and contact details, and whether you are the rights owner or act for them
  • why the listing is unlawful, with any evidence (for example trademark registration or a test report)

We will review the report promptly, usually within 3 working days. We may remove the listing and ask the Seller to respond. Sellers who repeatedly list unlawful items will have their shops closed. We cooperate with the Anti-Counterfeit Authority, KEBS, the police and other authorities on lawful requests.
